Competition news: the European Commission continue in-depth investigations into French and German support measures for Fret SNCF and DB Cargo
The European Commission is investigating whether French government support for Fret SNCF complies with EU State aid rules. Fret SNCF, a subsidiary of SNCF, has received cash advances of around 4-4.3 billion EUR to cover its losses. The investigation focuses on these cash advances, the cancellation of Fret SNCF's debt of 5.3 billion EUR, and a capital injection of 170 million EUR. At this stage, based on its preliminary examination, the Commission has concerns that certain measures in favour of Fret SNCF, which were taken during the period 2007-2019, are not in line with EU State aid rules.

A similar investigation was initiated at the beginning of 2022 by the Commission regarding German support measures in favour of DB Cargo. The European Commission received a complaint stating that certain measures benefiting DB Cargo may constitute incompatible State aid. The complainant argues that these measures give DB Cargo an unfair advantage over its competitors by allowing the company to invest in business growth and fleet upgrades despite being loss-making, without considering profitability or liquidity. The Commission will investigate the allegations to determine the validity of the complaint.
The outcomes of these investigations are yet to be determined, and the European Commission will release its findings in due course. FIATA will follow up on the developments in this regard.
